These Terms of Service ("Terms") govern your access to and use of the TrustedByAI AI visibility audit and related website (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
01What the Service is
TrustedByAI is an AI visibility audit tool. It runs real queries against third-party AI assistants and analyzes publicly available information about your business to estimate how visible you are when people ask AI for recommendations, and to suggest areas to improve.
The Service provides information and analysis. It is a diagnostic and educational tool, not professional, legal, financial, or marketing advice.
02Results are informational, not guarantees
Your audit results are a point-in-time snapshot based on the queries we run and the data available at that moment. They are provided for informational purposes only.
- We do not guarantee any particular search ranking, AI recommendation, mention, placement, traffic, lead volume, revenue, or other business outcome, whether from the free audit or from any paid service.
- AI systems and their underlying data change frequently. The same query can return different answers over time or between runs, so results may not be repeatable.
- AI visibility depends on factors outside our control, including how third-party AI models are trained, updated, and ranked; the policies and behavior of third-party platforms; your competitors' activity; and changes you or others make to your website, listings, and business information.
- Following any recommendation in a report is at your own discretion and does not guarantee a specific result.
Where we describe a service as improving AI visibility, that describes the work performed, not a promised outcome. We commit to performing the scope you purchased, not to achieving a particular result.
03No warranty on third-party AI or data accuracy
The Service relies on third-party AI assistants (such as ChatGPT, Gemini, Perplexity, and Claude) and third-party data sources (such as Google). We do not control these services and do not warrant the accuracy, completeness, timeliness, or reliability of any output or data they produce.
AI-generated answers can be incomplete, outdated, biased, or factually wrong, and may reference businesses inaccurately. We capture and report what these systems return; we are not responsible for the content of those third-party outputs.
04Acceptable use
You agree to use the Service lawfully and responsibly. In particular, you agree that you will not:
- Submit information you do not have the right to submit, or run audits for a business you have no legitimate connection to or authorization for.
- Use the Service to harass, defame, or harm others, or for any unlawful, deceptive, or fraudulent purpose.
- Attempt to disrupt, overload, scrape, reverse engineer, or circumvent the Service, its rate limits, or its security.
- Resell or commercially redistribute the Service or its reports without our written permission.
05Intellectual property
The Service, including its software, design, and brand, is owned by TrustedByAI and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service and to use the report we generate for your own business purposes. You retain ownership of the business information you submit.
06Paid services
The free audit is provided under these Terms. Paid services — including the AI Visibility Audit, the AI Visibility Foundation implementation, the AI Visibility Performance Report, AI Visibility Growth, the combined package, and any custom or add-on work — are subject to the separate terms, scope, and pricing presented at the time of purchase. In the event of a conflict, those purchase terms govern the paid services.
Prices published on our website are in US dollars, apply to the standard scope described for each service, and may change at any time before you purchase. Standard scopes may vary depending on website complexity, business requirements, and technical considerations identified during implementation; any change to scope is agreed with you before the affected work begins.
Delivery timelines are estimates. Some work depends on your cooperation and on third-party platforms we do not control, such as Google Business Profile verification, and delays in those areas are not within our control.
07Disclaimer of warranties
The Service, including any audit, report, recommendation, implementation work, or other deliverable, is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.
We make no warranty or representation that any specific ranking, AI mention or placement, traffic level, lead volume, or revenue will be achieved or maintained. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
08Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total aggregate liability for any and all claims relating to the Service is limited to the amount you paid us, if any, for the Service in the three months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Some jurisdictions — including certain US states and Canadian provinces — do not allow some of these exclusions or limitations, in which case they apply only to the extent permitted and the remainder of this section continues to apply.
09Changes to the Service and these Terms
We may modify or discontinue the Service, or update these Terms, at any time. When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
10Governing law and jurisdiction
TEMPLATE CLAUSE — PENDING ATTORNEY REVIEW. TrustedByAI is based in the Commonwealth of Virginia, United States. As drafted, these Terms are intended to be governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, with venue in the state and federal courts located in Virginia. This clause has not been reviewed by counsel and its enforceability against any particular client has not been assessed.
Multi-jurisdiction note (United States and Canada). We provide services to clients in the United States and in Canada. A Virginia governing-law clause does not necessarily displace mandatory local law where a client is located, and we do not represent that it does.
- Canadian federal law and provincial law differ by province, and the province in which a client is located may apply its own rules to the agreement.
- Canadian consumer-protection legislation may apply to Canadian clients regardless of the governing-law clause above, and in some provinces cannot be contracted out of.
- Quebec imposes additional requirements, including French-language requirements for contracts and consumer documents.
- US state law also varies, and some states restrict choice-of-law, choice-of-venue, or liability-limiting clauses.
[PLACEHOLDER — CANADIAN TERMS NOT YET DRAFTED.] Canada-specific provisions have deliberately not been written here rather than guessed at. A licensed Canadian attorney should add the applicable provincial governing law and venue, required consumer-protection disclosures, cancellation and refund rights, French-language provisions for Quebec, and any required dispute-resolution terms. Until that review is complete, treat this section as incomplete for Canadian clients.
